The litigation team is offering creative solutions to our clients’ most complex commercial disputes and represents clients in complex court and arbitration proceedings.
Members of the team have extensive experience gained in complex and multithreaded disputes, which require a combination of process skills and industry knowledge, as well as coordination of activities based on adopted process strategies. We use innovative process and tactical solutions, the basics of which have been developed in other jurisdictions. We successfully represent our clients in many precedential cases where there is no established court practice. Our litigation team members have earned significant victories before the Supreme Court in key sectors many times.

Investments, construction and environmental protection
We advise and support clients at each and every stage of their investment process starting from choosing a location through zoning aspects, environmental analysis, construction process and commercialization. We advise on complex administrative and court-administrative proceedings related to environmental law, planning and zoning aspects, construction law, expropriations, etc. Legal support is provided in ongoing investments and post-investment arrangements. In close cooperation with technical experts, we provide analysis and management of claims related to the construction process.
Public procurement and PPP
We advise clients from the private sector in preparations of the extremely formalistic tender process with extensive experience in Polish procurement realities. The advice includes strategic planning in choosing the right vehicle and/or partner for a successful bid. Representing clients before the National Chamber of Appeals and common courts is regular part of the advice. We provide advice at all stages of public procurement procedures, in particular in the infrastructure, military, medical and service sectors.
In PPP projects, we additionally support private partners with preliminary analyses, provide advice in the selection process and negotiations. Strong relations with clients based on quality and trust are key to a successful PPP project.
Real estate, transactions and financing
Our practice includes real estate advisory services and financing of real estate transactions, in particular in cross-border transactions. We provide to our clients legal and tax analyses from specific property and related transactions to the property issues that arise in commercial transactions and development including planning, environment, construction and taxation issues. We draft, negotiate and manage agreements and represent clients in all administrative proceedings concerning real estate aspects. Examination of the legal status of the real property, conducting land and mortgage register proceedings and litigation over the reconciliation of the content of land and mortgage registers is a significant part of our advice. When real estate is required for a greenfield investments, our multi-disciplinary approach allows advice through the entire process. Our team is also very familiar with the legal and tax aspects of special economic zones.
We are advising clients on employment related matters, in particular in relation to managers and key employees. Drafting employment agreements, management contracts and non-competition agreements is part of the advice as is support in social security and tax aspects particularly in cross-border relations. We have structured working regulations and orders tailored to the specific needs of the clients including working in multi-shifts, Sundays and holidays. Clients are provided with effective support when termination of existing arrangements is required and non-compete aspects are of significant relevance. We have successfully represented clients in labour disputes in courts.
We advise on all matters related to regulatory aspects of the energy market in particular with regard to the trade and storage of natural gas and generation and the trade of power. Advice is provided in the licensing process representing clients before the Energy Regulatory Office and in appeal proceedings in the Court of Competition and Consumer Protection. We have extensive experience in proceedings concerning prohibited property transfers, in disputes concerning the ineffectiveness of the bankrupt's legal transactions, as well as in the execution of material securities. We advise on distressed assets transactions. Our team has advised on the secondary insolvency proceedings of one of the largest insolvencies in the construction sector. We provide support to insolvency receivers from neighboring countries in cross-border insolvencies.
